1. Contents of the website

GHOST-Bikes GmbH (referred to below as “GHOST”) expressly points out that the bicycles, pedelecs and accessories pictured on the homepage, and respective images and other photographic material as well as the information about technical specifications shall not constitute a binding offer to the visitor of the website to conclude a contract. The details and information on the website shall exclusively serve as non-binding information to the interested visitor. The purchase of a bicycle, pedelec, or accessories is only possible through GHOST authorized dealers. The possibility to purchase from GHOST directly shall not exist. 

 

2. References and links

In the case of direct or indirect links to outside websites (“hyperlinks”) which lie outside the area of responsibility of GHOST, any liability will only apply to sites on which GHOST is aware of the relevant content and is technically in a position and could reasonably be expected to prevent the use of such sites if their content is illegal. GHOST hereby expressly declares that at the time the link was placed there was no identifiable illegal content on the relevant site. The current and future design, content or authorship of the linked site are beyond the control of GHOST. For this reason, the company hereby disclaims any responsibility for the content of all linked websites which is changed after the link is placed. This applies to all links and references within the company’s own website, along with outside entries in any guest books, discussion forums, lists of links, mailing lists, weblogs, and all other forms of databases set up by GHOST, which enable external write access. Responsibility for illegal, incorrect or incomplete content and in particular for damage arising from the use or failure to use information provided in this way lies with the operator of the site to which reference is made, not with the party which refers to the specific publication by means of a link.

 

3. Copyright and trademark rights

In its publications GHOST makes every effort to respect the copyright relating to images, graphics, sound documents, video sequences and texts which are used, and to use images, graphics, sound documents, video sequences and texts created by itself, or to make use of graphics, sound documents, video sequences and texts which are in the public domain. All third-party brand and trademarks referred to on the website are subject without restriction to the provisions of applicable trademark law and the ownership rights of the registered owner. The fact that they are mentioned does not imply that brand rights are not protected by the rights of the third party! The copyright for any material created and published by GHOST itself remains exclusively with GHOST. Without the express permission of GHOST any duplication or use of such graphics, sound documents, video sequences and texts in other electronic or printed publications is not permitted. 

 

 

4. Liability

GHOST shall assume liability for deliberate and grossly negligent breaches of duty in accordance with the legal provisions. 

In all other cases, - unless otherwise stated in paragraph 3 -  GHOST shall be liable for a breach of a material contractual obligation the fulfillment of which make the proper execution of the contract possible and the observance of which the contractual partners regularly rely upon (so-called cardinal obligation), the liability shall be limited to the replacement of such foreseeable and typical damage. Subject to the rules and regulations in paragraph 3, the liability shall be excluded in all other cases. 

The liability of GHOST for damages arising due to injury to life, limb or health in accordance to the Product Liability Act shall remain unaffected by the preceding liability limitations and exemptions. 

 

 

5. Data Protection

We take the protection of personal data very seriously and ensure that you will feel secure when visiting our website. Any personal data which is recorded as a result of visiting our website is processed in accordance with the applicable legal provisions, in particular the German Federal Data Protection Act (BDSG) and the German Teleservices Data Protection Act (TDDSG). How does the author process personal data?

In some areas of our website we offer you the possibility of contacting us. Any personal data which is communicated during the process will only be used by us for the purpose for which it has been provided. Your data will not be transferred to any third party.

 

What is personal data?

Personal data is information which makes it possible to identify an individual. This in particular includes your real name, date of birth, address and telephone number. Information which cannot be directly connected to your real identity (e..g. favorite websites or the number of users of a site) does not represent personal data. How is the transmission of personal data made secure?

In order to ensure that communication with you is secure we use SSL (Secure Socket Layer) encryption, which enables 128 bit encryption. According to our current state of knowledge 128 bit encryption can be regarded as secure. This level of security is achieved by all browsers of later generations. It may be necessary for you to install the latest browser updates on your PC.

 

What data is accessed?

If the website includes the possibility to enter personal or business data (email addresses, names, addresses) the disclosure of this data by the user is expressly on a voluntary basis. Where technically possible and reasonable, all offered services will also be made available without the need for users to enter such data, or enabling them to use anonymized data or a pseudonym. However, the correct entry of data, including optional data, will enable us to provide you with personalized and individual service. 

 

Are email correspondence and the contact form secure?

If you wish to contact the author by email or using the contact form, we must point out that under certain circumstances it may not be possible to guarantee the confidentiality of transmitted information in spite of the encryption (see above: “How is the transmission of personal data made secure?”). The content of emails can be viewed by third parties. We therefore recommend that you should send us confidential information only by the post.

 

Is my data recorded when I visit the website?

Every time a user accesses a page on our website and every time a file is retrieved, access data relating to this process is saved in a log file on our server.

This data is used to generate statistics which help us adapt our website to your requirements. Can I influence the use of my data?

Of course, the decision about whether and for what purposes we can use your data lies entirely with you. In addition, you alone decide if we may use your data for purposes of consultancy, advertising and market research. Here, too, any permission you provide can be withdrawn by you at any time. 

 

Do you pass on my data to third parties?

Personal data will be used by us only for internal purposes with regard to the customer relationship. Transfer to third parties will require your prior consent. Recording of personal data and its transfer to government institutions and authorities which are authorized to receive them will only be implemented in accordance with the applicable legislation and to the extent we are compelled to do so by court verdicts. All employees and service providers have been placed under the obligation of non-disclosure and compliance with data protection legislation by the author.

 

How can I check, correct or delete my data?

In accordance with § 34 and § 6b BDSG (German Data Protection Act) users have the right to request free information about any of their personal data which has been saved. In addition, users have the right in accordance with statutory regulations to have their personal data corrected, blocked and deleted.

Use of Facebook Social Plugins
