Terms and Conditions of Participation – POACHA Shovel

GIVEAWAY – Win an Exclusive GHOST POACHA Shovel

1. PARTICIPATION

GHOST is hosting multiple 24-hour giveaways ("Challenges") across various platforms – particularly Instagram, TikTok, and YouTube Shorts – as part of the Poacha campaign.
The specific content, tasks, and start times for each Challenge will be announced via the official GHOST channels (e.g. stories, broadcast channel, posts).
Each Challenge will only be active for 24 hours. Participation outside of this period is not permitted.
Depending on the Challenge, participation may involve:

Each valid and timely entry will enter a draw for one or more limited-edition POACHA shovels per Challenge. A total of 20 limited POACHA shovels will be awarded throughout the campaign.
The specific task and the number of shovels to be won will be communicated for each Challenge. Prizes are non-transferable, cannot be exchanged, and will not be paid out in cash.

The giveaway starts with the launch of the campaign on May 8, 2025, at 5:00 p.m. (CET) and ends on May 31, 2025, at 11:59 p.m. (CET).
Winners will be notified by June 1, 2025, at 6:00 p.m. (CET).

Participation is free and in no way linked to the purchase of any products. Eligible participants must be at least 18 years old and reside in Germany, Austria, or Switzerland.
Employees of GHOST-Bikes GmbH and their immediate family members are not eligible to participate.

2. PRIZE & DRAWING

The prize: One exclusive POACHA shovel.
Winners will be chosen at random and notified via direct message on the respective social media platform.
The selected winner has 5 business days to respond and confirm acceptance of the prize. If no response is received within 5 business days, GHOST reserves the right to reassign the prize.
Prizes will be shipped free of charge to an address within the EU or Switzerland.

3. INFORMATION ACCORDING TO ART. 13/14 GDPR

We – GHOST-Bikes GmbH, An der Tongrube 3, 95652 Waldsassen, Germany – process your personal data according to Art. 4 GDPR – including name, first name, date of birth, social media nickname, email address, and country – solely for the purpose of conducting the giveaway and potentially shipping the prize or sending birthday greetings/newsletters (based on your consent).
Your data will not be shared with third parties, except for data processors under Art. 28 GDPR and the platform operators (Facebook/META, TikTok, Instagram). No data will be shared within the Accell Group.
Your data will be automatically and irrevocably deleted after the purpose has expired and any legal retention periods have ended. If data is processed based on your consent (e.g., for newsletters or birthday greetings), this is based on Art. 6 (1) a GDPR and can be revoked at any time.

Please note that Facebook (META), Google, TikTok, and potentially other service providers are based outside the European Economic Area (EEA), particularly in the USA.
WE WOULD LIKE TO POINT OUT THAT THE USA IS NOT CONSIDERED A SAFE THIRD COUNTRY IN TERMS OF EU DATA PROTECTION LAW.
We have no control over how these platforms process your data.

Facebook (META) Promotion Guidelines, Facebook (META) Lead Ads terms, and Google Lead Ads terms also apply. Depending on how you enter the giveaway, the relevant privacy policies listed at https://www.ghost-bikes.com/datenschutz apply.

The winner expressly agrees that the organizer may use image material related to the prize and its awarding for media purposes within its web presence and social media channels.

4. PREMATURE TERMINATION

The organizers reserve the right to cancel or modify the giveaway at any time without prior notice if technical reasons (e.g., hardware/software issues, computer viruses, or tampering) or legal reasons prevent proper execution.

This giveaway is not affiliated with, sponsored by, endorsed by, or organized by Facebook or Instagram. All inquiries and responsibilities lie solely with the organizers as specified in Section 5.

7. SEVERABILITY CLAUSE

If any provision of these terms is or becomes invalid, the validity of the remaining terms shall not be affected.
Instead of the invalid provision, the legally permissible regulation that comes closest to the intended purpose shall apply.
The same applies in the event of a loophole in these terms and conditions.
